firm contact in Romania on the website of the Bundesministerium für
Umwelt, Naturschutz und Reaktorsicherheit of Germany in the section
regarding Renewable Energy Law Resources.
RMDT’s practice group in the field of renewable energy assists clients
in all areas of law involved in developing green field energy projects
(wind, hydro, and solar energy) with a special focus on production and
distribution of renewable energy. The firm’s clients are well-known
global players in this field of industry.
RMDT handles the projects from the real estate purchasing and
construction stages, all the way through to the regulatory and
administrative phases. We lead our clients throughout the procedures to
incorporate a company, obtaining finance, purchasing real estate or
securing certain rights over real estate (superficies, concession,
public-private partnerships), to obtaining the specific permits and
authorizations from the regulatory authorities in the energy field and
the permits and authorizations from other authorities (environmental,
cadastral and local). Our practice group has also assisted our clients
within the procedures for obtaining the grid connection permit, and for
the negotiation and execution of the grid connection agreement, as well
as within the licensing procedure, the operation on the green
certificate market, and the start of operations with day to day specific
legal issues in the energy field.
RMDT’s energy department also assists clients in purchasing already
existing and functioning energetic facilities, in various stages of the
process. Such assistance includes participation at tenders, support for
our clients during due diligence procedures, transfer of all the
agreements, licenses, authorizations, know-how and employees and during
the day to day operation of the respective energetic facility.
Most recent completed projects:
- RMDT’s energy practice group assisted a
major international firm in the field in developing two green field
wind farm projects in Romania. We have provided assistance
throughout the entire process, including in relation to the
following: incorporation of the companies in Romania; purchase of
real estate and/or securing other rights over the land; obtaining
the specific authorizations and permits from the local authorities
in the constructions field; obtaining the specific authorizations
and permits from the regulatory authorities in the energy field;
obtaining the grid connection permit; negotiation and execution of
the grid connection agreement; operation on the green certificate
market;
- RMDT assisted one of Europe’s largest
energy firms in relation to the following: acquisition and operation
of a large number of hydro electrical power plants acquired by way
of privatization from Hidroelectrica SA, acquisition of six wind
energy projects in various stages of development, investing into a
private hydro electrical power plant project, as well as assistance
with the intended development of two brown field electricity
projects in partnership with a state owned company in the field of
electricity. Our assistance included, among others, the following:
assistance during the tendering process, negotiation and execution
of the assets sale-purchase agreements and the project development
agreements, due diligence, obtaining the required permits, approvals
and licenses from the regulatory authorities;
- RMDT’s practice group also assisted an international firm active
in this sector in developing a wind park and obtaining the required
financial support amounting tens of millions of euros from EBRD.
